These terms are an agreement between you and OCTOPUS SERVICES, a SASU incorporated in France ("MCPal", "we"). They apply to the MCPal service: the website, waitlist, publisher dashboard, MCP gateway and subscription-management pages we operate at mcpal.io and its subdomains. "Publishers" are developers who publish an MCP server through MCPal. "End users" are people who use a published server.
By creating an account, accepting these terms in a sign-in flow, joining the waitlist or using MCPal after receiving notice of these terms, you agree to them and acknowledge our Privacy Policy. If you act for an organisation, you confirm you have authority to bind it.
You must be at least 16. If the law where you live requires a higher age or parental authorisation, that rule applies. Provide accurate information, keep your credentials secure — including any private links that grant access, such as a subscription-management link — and notify us promptly of unauthorised access. You are responsible for activity under your account except to the extent caused by MCPal's breach of its obligations.
MCPal is a technical gateway through which publishers make their MCP servers available. MCPal provides sign-in, request relay, usage quotas, subscription checkout, entitlement checks and usage statistics. Publishers, not MCPal, operate the upstream servers and supply their tools and outputs.
A server may include a free quota and offer a paid plan after that quota is used. Before payment, we display the server, the price and billing period, the publisher's identity and a link to the publisher's terms. Stripe processes payment on the publisher's connected account. MCPal may receive a platform fee.
Paid plans renew automatically for the displayed billing period at the displayed price until cancelled. You can cancel at any time from the subscription-management page. Ordinary cancellation is free, is confirmed online, stops renewal and takes effect at the end of the current paid period. You keep access until then and can reverse a scheduled cancellation before that date. If you lose access to the subscription-management page, email [email protected].
When a publisher deletes a server, all of its subscriptions are cancelled before the server is deleted, and no further renewals are charged.
Refunds and statutory withdrawal rights are handled by the publisher under its policy and applicable law. EU consumers normally have 14 days to withdraw from a distance service without giving a reason. If you ask for a service to start immediately and then withdraw, you may owe a proportionate amount for what was provided before you withdrew; the publisher's terms set out the details and any statutory exceptions. Nothing in these terms limits mandatory consumer rights.
If a publisher buys a paid MCPal platform plan, its order page states the price, billing period, taxes and included features before purchase. Unless stated otherwise, the plan renews for the same period until cancelled. Cancellation takes effect at the end of the paid period. Prices may change for a later renewal after reasonable advance notice; a publisher may cancel before the new price applies.
Where an invoice to a business customer goes unpaid past its due date, the late-payment interest (three times the French legal interest rate) and fixed €40 recovery indemnity prescribed by the French Commercial Code apply automatically.

Anyone can report content on MCPal they believe is illegal by emailing [email protected], identifying the server and giving the reasons. We review notices, act on valid ones, and inform the affected publisher of the reasons for any restriction or removal.
MCPal and its licensors retain rights in the platform, branding and documentation. Publishers retain rights in their servers and content and grant MCPal a worldwide, non-exclusive licence for the relationship to host their server's name, logo and description, display metadata and relay traffic solely to operate and promote the service. This licence ends when the material is no longer needed to provide the service, subject to routine backups and legal retention.
We use reasonable care and skill to operate MCPal, but internet services can experience maintenance, security events and failures outside our control. We do not promise uninterrupted availability. Publisher servers and their outputs are supplied by independent publishers. Stripe and other third-party services are also governed by their own terms.
MCPal is responsible for direct, foreseeable loss caused by its breach of these terms, subject to applicable law. MCPal is not responsible for a publisher's server, output, unlawful content, refund obligation or misuse, or for loss caused by the user's unauthorised or unlawful conduct.
For publishers acting in the course of business, to the extent permitted by law, MCPal is not liable for indirect loss, lost profits, lost revenue or loss of business opportunity, and MCPal's aggregate liability in a twelve-month period is capped at the greater of EUR 100 and the amount the publisher paid MCPal during that period. The cap does not apply to fraud, wilful misconduct, gross negligence, death or personal injury, or liability that law does not allow us to limit.
Consumers retain all mandatory statutory guarantees and remedies. No exclusion or limitation in these terms applies where it would be unfair or unenforceable under consumer law.
You may stop using MCPal at any time and request account deletion as described in the Privacy Policy. We may restrict or suspend access where reasonably necessary to address a material breach, security risk, legal requirement, payment failure or harm to MCPal or others. Where practical, we will give notice and an opportunity to remedy the issue.
If we restrict or suspend a publisher's account or server, we will give the publisher a statement of reasons. Except where the law requires immediate action or the publisher has repeatedly infringed these terms, we will give at least 30 days' notice before terminating a publisher's access.
Server deletion is permanent. Subscription cancellation must complete first. After that, MCPal removes the server's end-user accounts, credentials, registrations and platform usage data, subject to the retention and backup periods in the Privacy Policy.
We may update these terms for legal, security, technical or service changes. We will post the new terms and give at least 30 days' notice of a material change, and publishers receive at least 15 days' notice of any change that applies to them, unless an urgent legal or security reason requires less. Changes do not apply retroactively. If a change adversely affects an ongoing paid plan, you may cancel before it takes effect. Renewed acceptance may be requested at sign-in.
These terms are governed by French law. If you are a consumer, you retain the mandatory protections and courts available in your country of habitual residence. Otherwise, after a good-faith attempt to resolve the dispute, the courts of France have exclusive jurisdiction to the extent permitted by law.
